Gilbert Legal: family law in Albany WA
Gilbert Legal is a family law practice on the corner of Aberdeen Street and Peels Place, in the centre of Albany. We have been open since May 2012. We act for people across the Great Southern who need family law advice in Albany, and we also take on matters in Perth and other parts of regional Western Australia. Our work covers all aspects of family law, from a first conversation after a separation through to representation in the Family Court of Western Australia. Where a matter can be resolved without a hearing, we work through Family Dispute Resolution, negotiation and mediation. Where it cannot, we appear in court.
A practice that does family law and little else
Our Legal Practice Director is Nerida Gilbert, who has practised exclusively in family law since 2010. Nerida was born and raised in Albany and returned here in 2010 to start the practice. Before studying law she held senior management roles in legal research and information services in Perth, Melbourne and London, and she worked as a university tutor in legal research. Jessica Peake also works at our Peels Place office.
Because we appear in the Family Court of Western Australia at both Perth and Albany, a Great Southern client does not have to instruct a Perth firm to have a matter heard in Perth. We brief Counsel where that is appropriate to the matter.

Our family law services
- Property settlement: the division of property, including superannuation where applicable, following the breakdown of a marriage or de facto relationship, by negotiated settlement, mediation or Family Court proceedings.
- Children’s matters: arrangements for who children live with, where they live, and what time they spend with each parent, approached first through Family Dispute Resolution and negotiation.
- Consent orders: the preparation and drafting of orders where an agreement has already been reached, either as a fresh application or within existing proceedings.
- Binding financial agreements: a written agreement setting out how property is to be divided, which can be entered into before, during or after a marriage.
- Divorce: the formal ending of a marriage, at a fixed fee, available after 12 months separation as either a joint or a sole application.
- Spousal maintenance: the ongoing financial support of one party to a marriage or de facto relationship where that person cannot support themselves.
- Family Court proceedings: advice and representation in all matters heard in the Family Court of Western Australia.
Wills, enduring powers and deceased estates
Alongside the family law work, we prepare wills at fixed fee prices. We also prepare enduring powers of attorney, which appoint a trusted person or persons to make financial decisions, and enduring powers of guardianship, which cover personal lifestyle and health decisions. Where someone has died, we prepare applications to the Supreme Court for a grant of probate, or for letters of administration, on behalf of the executors of a deceased estate.
